Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and NotifyMe ("we", "us", or "our"), governing your access to and use of the NotifyMe Discord bot and related services available at notifyme.bot (collectively, the "Service"). By adding NotifyMe to your Discord server or using any of its features, you agree to be bound by these Terms.

By using the Service, you confirm that you are at least 13 years of age (or the minimum age required by Discord's Terms of Service in your jurisdiction) and that you accept these Terms in full.

2. Description of Service

NotifyMe is a Discord bot that allows users to configure notifications and alerts based on keywords, URLs, or other user-defined criteria within Discord servers. The Service is offered in two tiers:

Free Tier — available to all users at no charge, with limited features and usage quotas.

Paid Tier — available through a monthly or yearly subscription, or a one-time lifetime purchase (note: lifetime plans are being discontinued), offering expanded features and higher usage limits.

3. User Accounts and Eligibility

To use the Service, you must have a valid Discord account in good standing and comply with Discord's Terms of Service (https://discord.com/terms). You are responsible for all activity that occurs under your Discord account in connection with NotifyMe. We reserve the right to refuse or terminate access to the Service at our discretion.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

Violate any applicable local, national, or international law or regulation, including EU/Portuguese law;

Harass, abuse, stalk, threaten, or intimidate any other person;

Distribute spam, unsolicited messages, or bulk commercial communications;

Attempt to gain unauthorised access to any part of the Service, our servers, or systems connected to the Service;

Transmit any viruses, malware, or other harmful code;

Scrape, crawl, or otherwise extract data from the Service in an automated manner without our express written permission;

Impersonate any person or entity, or falsely represent your affiliation with any person or entity;

Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to immediately suspend or terminate your access if we determine, in our sole discretion, that you have violated any of the above.

5. Intellectual Property

The NotifyMe bot, including its source code, design, branding, and documentation, is the exclusive property of NotifyMe and is protected by copyright and other intellectual property laws. These Terms do not grant you any right, title, or interest in or to the Service beyond the limited right to use it in accordance with these Terms.

6. Third-Party Services

The Service interacts with Discord's platform and may integrate with third-party services. We are not responsible for the availability, content, or practices of any third-party service. Your use of third-party services is governed by their respective terms and privacy policies.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOTIFYME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE EXCLUDED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We may also update these Terms from time to time. We will notify users of material changes by posting a notice in the NotifyMe support server or updating the effective date above. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

10. Termination

You may stop using the Service at any time by removing the bot from your Discord server. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, all licences granted to you under these Terms shall cease.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Portugal. If you are a consumer resident in the European Union, you may also benefit from mandatory consumer protection provisions of your country of residence.
